I'm 17 and will be 18 on 6/22/06 and my boyfriened will be 21 on 6/15/06 and we have not had sex nor plan on it til we get married which we plan on doing when I turn 18.yet I was sent a not so appropriate video to my phone from him, so I need to know can my mom press charges for stachitory rape agaist him if we have not had any sexual realtions whatsoever?

However, since you haven't had sex yet, he can't be charged with statutory rape. However, he may be able to be charged with sexual assault IF it can be proven depending on the laws in your state.

Well apparently you're already both of legal age already, so no. Besides, this isn't a sexual assualt. In a lot of states, the age of consent is under 18 anyway. The real problem here isn't the video; it's the silliness of the situation. Even if your mother tries to file a complaint with the police, I doubt if there's a law they can use to prosecute your boyfriend. Pornography is legal and few cops will bother with such a petty case.

What really seems to be the problem here is the weird situation with your mother. I suspect that you're going to marry this guy to get out of the house. Your mother doesn't approve of your boyfriend and is doing whatever she can to prevent the relationship. You need to really evaluate the guy through your mother's eyes just once. If you still think he's an OK guy, then do whatever. But if you have to excuse his behavior with things like "oh, that was just a few weeks in jail" or "he's not a criminal, he just sells a little dope on the side", then you're making a mistake. You'll wind up married young, pregnant, and trapped.

Statutory rape (or sexual assault on a child) is the least of your worries.

I'm sure she can press charges for whatever the heck she wants, but the pertinent question is, has he committed statutory rape? I'm *pretty* sure the age of consent is at most 18 in all 50 states, so if you are 18 when you firast have sex, then no problem. However, some states may have laws about transmitting "obscene" material to a minor that you may, if your mom is crazy about that, want to look into. Talk to an attorney for more details; also keep in mind that unless you were in different states at the time, that is just a state matter, but if you were in different, it's federal, and I KNOW there's a federal law against it (perhaps you heard of the case about the joke a friend sent to a friend about floatation devices and Pamela Anderson's breasts?)

If you have not had sex with him the answer is no, your mother can not press charges against him for stachitory rape, she could only do that if there was proof that the two of you are having sex while you are still a minor, and he is not. So I would not worry.

Statutory rape, no. But there could be some charges based on providing lewd material to a minor. Not as serious, but still a crime. It depends on the local laws in your state.

No......you haven't had sex unless you're the one in the video and the contents/acts occurred before you turned the age of consent in your state. From the dates listed, you're already 18.

He can only be prosecuted for the act itself, not sending you video.

Dealing with your mom is a different story entirely.
