You are pretty vague here but I am thinking you spanked your child and are now under investigation? If that is truely what happend, you spanked her and she called the police, there will be an investigation. It will be a huge pain in your butt, however, I am confident that the social workers will drop the charges IF THAT IS WHAT HAPPENED. You are allowed to discipline your child, you just aren't allowed to abuse your child.

You have the same rights as any defendant facing criminal charges. The right to consult with an attorney, the right not to answer any questions, the right to a trial. The prosecution needs proof beyond a reasonable doubt. That may include medical reports, eyewitness testimony, etc.

If the last part of your question alludes to whether or not your underage daughter will be allowed to testify for or against you, yes, anyone can be a witness in court. If she is also the victim, you have even more to worry about than that, however. You need help.

Your rights are the Miranda rights. You know: you have the right to remain silent, you have the right to an attourney. If you cannot afford an attourney.... They were read to you when you were arrested.
