if you are unmarried but have cohabitated for the entire year as a stay at home mom, and have one child who belongs to the person employed and onechild of your own. (the person emplyed also supported your son) . is it possible for the employed person to claim all four people? how do you find out if you are a "qualifying other" ? where is this information located on the IRS web site?

He can claim all the children (not you), and be sure that the filer checks the Head of Household box.

Qualifying Person

See Table 4 to see who is a qualifying person.

Head of Household

You may be able to file as head of household if you meet all the following requirements.

1. You are unmarried or “considered unmarried” on the last day of the year.

2. You paid more than half the cost of keeping up a home for the year.

3. A “qualifying person” lived with you in the home for more than half the year (except for temporary absences, such as school). However, if the “qualifying person” is your dependent parent, he or she does not have to live with you. See Special rule for parent, later, under Qualifying Person.

The Head of Household can claim both children. He would claim his own as a dependent and qualify for ctc and the son would be claimed as a dependent, but only receive $100 for him, even if he is the sole provider.

No- the child that is not his has to be claimed by you or the father of the child, whatever your agreement is.
