i have been sick in the hospital and he feels like he failed as a husband and says he don't want it but it has to be done

i brought up divorce because i was mad and he ran with it. he said he has to do it but it will hurt him. i told him i don't want it and i think we can work it out or wait till i get out of the hospital then if u want it okay. he says he is stressed with taking care of all the bills and working long hours. but i feel it should happen cause he is not there for me like he should be but i don't want him to go anywhere. we both luv eachother a lot but yet we are not on the same page

He's looking for an excuse. What kind of husband would even talk about divorcing his wife while she is sick and in the hospital.
Something else is going on. You need a husband that will help you get better.

Talk to a lawyer. Don't sign anything. You may be taken for a ride. On the other hand perhaps he is trying to protect some assets if you have been in the hospital a long time. Who knows? Anyway if someone wants a divorce they get a divorce. It doesn't matter what the spouse wants. The days of forcing someone to stay married are over.

He has failed as a husband. Let him go! FAR AWAY.

While I agree with all of the other answerers, I'll tell you the answer to your real question - FILE YOUR RESPONSE TO THE SUMMONS.

I am having to do my own divorce and if he does not file his response to the summons for the petition of dissolution, in 31 days he is divorced ANYWAY! And so will you be, if you do not file this paper with the courts.

give him the divorce it could easily be a blessing to you , every time i don't think i can believe that , i look at what my ex husband married and karma works , good luck and good health

Don't sign the papers. He can stop it , by just going to his lawyer and put it on hold. or off. . Hope your ok things work out. Pem

They will ask in court if you both want to do this, if one says yes, then it can go through, but if both done, they dont make you you it....
