I think you have to petition the court to get your maiden name back--otherwise your marrief name is still your legal name.

I kept his name only because I have 3 young kids. I want them to have as much stability in all this madness as possible. I am afraid that if I go back to my maiden name they may think that I am 'divorcing' them as well because I don't even want to be acknowledged with their last name. I will keep it till I get re-married or till they get a few years older and can understand a little more of the reasons surrounding the divorce.
It really has to be an individual decision. My sister is divorced and took back her maiden name but she doesn't have any kids.

If I ever get a divorce (I'm a man obviously) I will change my last name if she doesn't change hers. I'll not have my last name laying on the floor getting it from some other guy. If I were a woman, I would change it back to my maiden name.

It's okay to keep it. Especially if you have kids together. I'm divorcing my second husband. (Really brief marriage) And I'm going back to my first husband's last name because I've had it lots longer than my maiden name. So, it's your choice. Do what feels right to you.

I am keeping my married name because of my son. But then again my maiden name is a crazily long polish name and my married name is only five letters. I think it is very okay in a situation like mine.

You can go back to your maiden or keep the married. Some people keep the married if it doesn't bother them - it saves them time and money from having to change driver's license and ss cards back over. If you truly dispised him and want to switch it then - ss card is the time and DL takes money - so your choice

Either way -- as always, it's a pain to change everything (credit cards, accounts, checks, social security card, etc.)
Depends on how long you've had it, if you want to keep it.
Also - will there be a bad taste in your mouth if you carry his name?
What about kids -- that might make it confusing if you don't take his name, but the kids have his name.
Best of luck to you!

I wanted no connection to the bastard I was married to and in spite of having 2 children with his last name, I took my maiden name back. Its your own choice.

I did. I didnt want to go back to spelling my last name (maiden name) again. Plus all my professional licenses and certifications are in my married name.
