That the penalties of law cannot come as a surprise.

Due process requires notice before any adverse action is taken by the government (or any govt agency), and a hearing at which the person being adversely affected can argue their position.

Those two components, notice and a meaningful opportunity to be heard, provide some safety net to prevent penalties from being arbitrarily imposed.
