I gave notice. Employer said he would pay additional 2 weeks as compensation(vacation, sick) on same check as last 2 weeks worked. I owed $109.00 for services to his company. Employer asked me if he should mail paycheck. I said I would pick up. I paid the balance voluntarily prior to getting the paycheck. I left and then opened the envelope to find a check for the 2 weeks worked only with a letter stating that he was holding the other promised 2 weeks until the balance was paid. Is this legal? I left a message for him that this balance was paid and to mail the other check. It has been 3 business days and I still have not received it. What can I do?

You claim that the money withheld was for "services"? Does that mean you "hired" his company to do work for you, and agreed to pay them back?

If this is the case, under Title III of the US Labor Code, their taking your money from your check constitutes an illegal garnishment. You could sue them for reimbursement plus $1000 in penalties.

Just point it out to your employer and see if it's worth $1000 to hold your pay for couple more days.

No, this is not legal. He owes you for services you performed, he can't withhold it from your check. Contact the attorney general in your state and leave your ex-boss a message that you are doing just that.

Call the Department Of Labor for whatever state you live in. They will help you. They can't hold your paycheck.
