Yes they can. Although it's not enforced yet, every internet retailer technically should have a tax table of every county in the nation, and charge taxes appropriately. It's rare companies go this route, but I design sites for a living and I have a few clients who subscribe to those tax tables I mentioned so they can charge tax based on where the product is shipping to, which is technically the legal way to do it.

I work for a company that does that. We have to, if the customer is inside of California, because that's where we are. If you don't want to pay sales tax, remember to check where the company is based. If they are in the same state as yourself, they may be obliged. On the other hand, some companies do try to milk you for "taxes" that are not owed, so reading up on the sales tax policies of your state will help you to have a better grasp of what is and isn't legal.

Of course. A company in California will charge you California State Sales Tax for all products they sell on-line, even to someone who lives in a state with zero sales tax. Now you may have to pay a "usage tax" to your state for the stuff you bought on-line. You'll have to look into your state tax laws to find out.

If they have a retail store presence in the state, they are required to collect any sales tax that the state may charge. Some states have suggested that all companies collect sales tax, but this hasn't had much success.

Oh, goodness yes. They are actually required to do so by law unless your billing address is located in a different state than their headquarters. Find out where they are located and if they are not in your state, call them and ask for that money back if they charged you for taxes.

sales tax will apply if the company does business of out same state you are in. If the company itself is not located there, but if they have a sales rep selling in that state, sales tax will also apply.

Yes. It usually depends on where the item is purchased and where the buyer is located. If the item is located in GA and the buyer is in GA then they have to pay sales tax.
