If two people are married and one owes child support arrears, can the state take the stepparents income tax return? This is in Ohio by the way. Thanks for any help.

If it is the same as WI--yes. But the good news is that you can ask your tax preparer to file an "injured spouse" on your behalf. That way they can only take the debter's portion of the return (or 1/2 in marital property state.)

Think about it tho--WI charges 12% on arrearages. So if OH charges interest on arrears--you may be better off getting this debt paid down/off.
