I work in law Enforcement as a Assistant Jail Administrator. This year we are losing our sheriff and we have 8 candidates running. One of the candidates in an open forum in the paper, stated that myself and the Jail administrator do not "know our jobs", are "Imcompetant", and that "do not do our jobs, or don't know what they are. This is in print. This creates a hostile work environment now that staff are talking about it as well as inmates. Any recourse at all??

You can always sue for slander but there is one catch that is very hard to prove: you have to prove that the detrimental or negative statements were of 'malicious intent'. That means that you have to prove the person intentionally set out to damage your reputation... you have to prove that he had a specific reason or motivation and gained something from his comments.

This is normally very difficult to prove.

PS I just remembered a case a few years ago similar to yours. Sometimes if you contact the editor of the newspaper they will print your rebuttal. Give the editor a call and discuss it with them.

This seems to be to be more like an opinion than an outright verbal slander. You could talk with an attorney but I think you'd have a weak case at best.

It would be very hard to prove slander. This guy's lawyer can always claim that this is his client's personal opinion, and he is entitled to believe what he wants, and we are in America, and the freedom of speech is one of our rights. To prove slander you have to prove deliberate and malicious intent to discredit you.

Oh come on. WAKE UP!!! Of course you have redress in this situation. But are you sure he may not have a point? I mean, asking that question OUT LOUD of your head?

Don't worry, they've just created their own he!!. Just keep doing your job and keep proving you know what you're doing. That person will be lucky to have a job. It would be a shame he was caught in the prison yard alone wouldn't it? hehhehe....
