Okay, so I'm looking for the law refering to no smoking in resturants and near enterances.
Here's the deal. My crew is getting blasted by cig. & weed smoke at the delivery window of our resturant. We suffer coughs, burning eyes and lungs, some have asthma. Three are pregnant and worried about their babies.
We have asked the owner for a no smoking sign at the window.
Thus far he has ignored us.
We want a petition as the next step, but want to quote a few laws as back up.
And if that fails, I suppose we'll take it to the next step.
So, any help &/or suggestions mucho appretiated.

And, with a sign, we can refuse service. Without one we're out of luck.
And, when their smoke filled vehical is right against the delivery window and we have to open the window to collect and hand them the food, there is no stopping a face full of smoke.
When the dude is handing you a quarter at a time, inbetween puffs, our lungs suffer.

So, why do you think I have the control mentality when it is you that forces his poison on me?
And, if laws object to your car spewing enviromental & health hazard fumes, shouldn't that include what's in your car? Unless, of course, you keep your windows completely closed, keeping your fumes to yourself.

I agree, I hate smoking and being near anybody that smokes. If they do, I leave their presence, regardless if its insulting or shows disrespect.
I think what you could do is where gas masks at the window. i KNOW its kinda extreme, but this will attract attention to your cause. If your boss tells you to take it off, tell him 'I'm not willing to risk my life just to give a guy his burger. ' or I don't wanna get sick.'
I don't know too much as to what is okay for you to do at the window, but maybe it could work. Unless you're totally not willing to get fired

I am sorry to say that you probably won't be able to control the smoke coming from their cars, even though emissions have to be controlled. Maybe people can pass non-smoking laws based on those aspects, as you said. I too hate smoke and worry about the physical effects of it on pregnant and nursing women. Since you're in california, you might have laws about it sooner than the rest of the country. As for me, I'm stuck in east new mexico, with a west texas mentality where some businesses still allow their employees to smoke on the clock in the building.
If your state/city does have an ordinance regarding a distance from openings, print it up and show it to your boss. If he still does nothing, call the department of labor and they can help you next determine what to do. And if your boss fires you for trying to stand up for your rights, you could have a lawsuit pending. I'm not sure what the labor laws are in CA, but I do know that you would at least be entitled to unemployment if you were terminated on those grounds, if not more.

Seattle has laws. No smoking within 25 feet or building entrance, open window, vent.
No smoking in restaurants and bars.
Or within 25 feet of bus shelter.
Bar owners ain't too happy about it and I can see THEIR point. I'd be inclined to exempt bars from that law. Don't want a complete and total Nanny State.
I am smoker and I am not in twist about new laws.
Its probably the wave of the future.
But I would exempt Bars.

The laws are in place the owner does not have to like it but he MUST comply. I do feel it is a smokers right to have a nice,dry,safe place to be. That is reason they are out there, there is No place. That is unconstitutional and unjust. But that is another issue O_- I do agree wholeheartedly that you should not have to be near it that is just not right. So call the city and have them enforce it the law is clear and there to enact. All the best ,that owner should prefer compliance to losing business because of court dates. Take care ~A~

Type in your state, city and smoking laws or you could go to the local city building and ask to see the ordinance.....The area that may be a little gray is that they are in their car,,, but at the same time they are near the "entrance/exit" of a building. You always could refuse to serve them

properly, Minnesota regulation aside, except you artwork for the government that is a private development. See, that's what i'm speaking approximately. A ######### eating place is a private place. that is in basic terms the owner's company if he chooses to permit smoking. Wisconsin can kiss my ###. they do no longer understand the seen inner maximum components.

Bring the topic to the City Councilors. But if you can make it through with the Mayor, much better.
And for your immediate solution, get a small electric fan to blow it away.
