First you have to get a lawyer, which is really expensive. (i called a patent office and they said it costs from $1500-$6000 depending on what you are getting a patent on) Then your lawyer will research your idea to make sure there aren't any like it already. Once that's finished, you have to pay a patent office to take your idea and make it yours. This means no one else can take that idea or name and use it but you. It costs a lot of money for all of this, but if you have it it's worth it!

NOLO is a great, free informational site. Also, be sure to read what the USPTO (United States Patent & Trademark Office) has to say about patents.
Associations may be a good avenue to explore. These organizations will address many of the thoughts, questions and concerns you'll inevitably have as well as many you haven't anticipated yet. See the source box for some relevant links.
Research, research, research – this cannot be stressed enough. Read as much as you can. Here are some book titles that are relevant:

You have to see a patent lawyer who will tell you whether you patent is worth the price to get it in the first place. Now before you see him have the ideas set down in great detail and placed in the hands of another lawyer who will examine them and keep them in his safe for future reference and to prove that they existed on a particular date because after you show them to the patent lawyer he may tell you one thing and do something else later, so as you see this lawyer thing is a real bear to handle. So if you think you still want to get a patent you need to spend alot of money and hope that no one else had the same idea and already has a patent on it which will cost you just to research that one. So how much can you make from this thing that you want to patent because if it isn't much you may want to forget the patent and just make them and sell them on your own.
