To make a long story short, I work in a hospital & was going up a stairwell when I ran into a stack of heavy duty corner bead (used on corners when plastering walls) . A contractor doing work on the hospital layed it down extending out over the stairs & acrossed & blocking the next set down. Only I was coming up the stairs & ran my head right into them & knocked em down. I may have looked to grab my wallet outta my purse, but security is not happy whatever the case may be. They said theres no reason those idiots should have left them there. All of this was caught on the security tape. I was only treated by the employee nurse. Which was fine, but now it seems to be that I am going to have a nice scar there. I have very good complexion & no scars on my face, I am going to be furios if it leaves one. SO MY QUESTION IS. Do I have a case? If I end up with a scar from an injury, do to their neglegence can I sue them?

Not sure plastic surgery or something along the lines would do any good. Its about the size of a quarter & was an abrasion not a laceration. (I was quite lucky, it is just above my eyebrow). Had it been on the brow bone it would have split it wide open or could have taken my eye out. They weighed a good 50lbs & were 12 ft. long. THANKS FOR ALL THE HELP!

I know I cannot sue the hospital, even if they were my employer. I work for a contracted company that processes requests for medical records. But I am there 40 hours a wk. But I know it was the contractors fault. But the hosital nurse did tell me if I did choose to go to the ER that the hospital would pay for it. I wouldnt have had to turn it in to my employer for WC, like I would have to for any other injury,

Mine is called frontal lobe epilepsy due to the area where my head was hit Get an x-ray done at the Hospital...get a doctor to see you immediately and not the company doctor at your work.

The only one you have a case against is the construction company hired by your employer. Since it was total negligence on the part of the construction company, then they are the ones that you would sue. It would be the same as if you were walking down the street by a construction site and were injured by something from the site. You sue the contractor. The place of employment was the setting.

It sounds to me like the contractor was negligent. They blocked the stairwell and did not post any kind of warning signs. If it was caught on security tape, then security should have known about the hazard and my be negligent as well. I'm not a lawyer an don't know who you can or can't sue, but I think you have a case.

Yes you have a case. You'll need to find a lawyer that will accept it though. It doesn't sound like you're going to get a whole lot out of it though. The suit will be made against the contractors.

You can not sue the hospital because workers compensation laws prohibit that, but you can sue the contractor.

Yes because it should not have been in the way and if they did leave it in the way it should have been marked so people don't run into it.

It's just like when you go in places and they don't have signs letting you know the floor is wet or sticky and you fall.

Before you talk lawsuit, talk to your employer about doing something about the scar.

yes you do have a case! you can get a good lump sum for scars to the face and neck!!
