My husband and I are going through a divorce. He is over seas and does not want the divorce and refuses to sign any papers. I am divorcing him while he is away because when I tried to leave him before he left he made things miserable for my son and me and my parents. Constantly calling and harrassing us and I went back but since he has been gone things have been so much calmer and happier. Well about a month ago he decided that he no longer wanted me to have access to his money because he thought I was spending too much of it and I never told him what I was spending it on so he opened a second bank account with his mother and has all of his money put into that account he doesn't give any money to me or the baby even though we are still "married" Is this abandonement or does it have to go on for a longer period of time. I do work full time and can pay the bills but I called my lawyer but wasn't sure or what questions i should ask. Any advice or help is greatly appreciated. Thanks!

He sounds like an ***. You shouldn't let anyone treat you that way, even your husband. I'd go on with the divorce. Tell your lawyer exactly what you just said & take it from there.

He's out of the country and you start divorce proceedings! That's a little, no wait, that's a lot lowlife. You have no reason to complain about his cutting off his money from your access. It is not abandonment it would be preservation of bank account. Did you have the nerve to use his money for your divorce lawyers retainer.Sounds like you want out he's making it easier. Get out.

Is he in the military? If so all you have to do is contact his CO and they will arrange for a stipend from what ever money he is making. You can't get a divorce on the grounds of abandonment if he is in the military. You can leave him. Go get a job and go on with your life. In a few short years then you can divorce him.

Just tell your atty what you said above and tell him to proceed with the divorce. Especially mention the part that he is hiding his money in an acct with his mother, neglecting his wife and son. You will automatically be awarded your son along with child and possible spousal support. Since he wants to be this way, sue his butt for everything that you are legally entitled to. You may have to show evidence why you believe the other acct exists and anything else you think hes hiding with his mommy. Good luck

It all really depends on what state you live in, different states have diff laws.... I would think that it would be some type of abandonment if you are paying everything on your own and he has his money seperate. i dont know if it is the same where you are from but in mississippi if he leaves the household and isnt helping with any household bills then it is abandonment. check with your lawyer

Get a good divorce attorney. He'll know what questions to ask.
