He just hate me because I'm #1 on most major search engines and his web site is banned because of link farms and stuff. He's using ugly old design, invalid HTML code and table layout. I'm using valid XHTML and CSS table-less layout. Our graphics designs are completely different... This is his last email:

I would never copy anything from his ugly site and his code is one big mess so there's no chance he's right.

No one is getting sued here. He obviously has no case, I'm sure you would have received something official from the courts if he was serious as well.

Meanwhile, you can't sue him, because he hasn't done anything apart from pester you with emails. There is no slander here like other people are saying. Where is the insult? On top of which, even if he had insulted you it would be in a private e-mail which *you* chose to make public.

If he actually has a court date, the courts are required to send you a notice, so you know that your supposed to show up, call the courthouse, be like WTF.

I don't believe plagiarism violates any laws now, although I could be wrong (not saying you did/didn't though).

You might be able to sue for damaging your image.

From what I know, if he has a copyright rights, then he can sue anybody from copying his online work, especially if he has proves. If not, don't worry about it. Anyway, like one member suggested, sue him for slandering. Sueing someone for slandering online is legal especially if you have all the proof to show in court later.

The difficulty is the amount of money you have to spend on defense. If you are ready and willing to do it it is easy to defend code on web sites because of posting dates. you can track employees and intellectual property and prove his claim malicious but unless you can prove his claim actually amounted in financial harm slander is impossible to win. Elegant code is something few people recognize.

Good luck and unless the court notifies you he is just blowing smoke. Relax and count the bucks.
