Yes. And here is where it is prosecuted:
Husband is charged with rape. Husband claims the rape was with the consent of the woman. The prosecutor is convinced he is guilty. The jury comes back not guilty to rape.
The prosecutor, based on the husband's own testimony (he had to testify to have a defense of consent, since the victim testifies that it was rape) charges the husband with adultry.
This happens often (not frequently, but not unheard of).

In the Military it is against UCMJ (Uniform Code of Military Justice), and can result in jail time but not likely. Just for laughs, its also against UCMJ to have sex in any position but missionary position. Who says military law is outdated? lol

Most states have a law against fornification (sex with someone who is not your spouse) on the books.
However, they are hardly ever enforced.
So technically, yes. In reality, no.

I heard of going to hell, I've heard of losing all your money in the Divorce, I heard of your clothes being burned, cars torched.......but can't say I've heard of jail. At least not in America.
