Ok, so my brother nd sister in law are moving to the isle of wight. they have a spacious 3 bedroom flat, and we (my boyfriend, my son and i) live in a tiny 1 bedroom flat. We want to move into their flat and pay them the rent into their account so that lambeth can still take it out of their account. What i want to know, is that if we tell laambeth that we have been staying with them, and we have nowhere else to go, would they still move us out? and what would happen to us if we got found out? Also, how would we deal with the issue of council tax? Please note this is just an enquiry, nothing illegal has happened!

If so, you may be able to mutual exchange with your brother and sister in law and then after doing so they could end what would previously have been your tenancy and move to the isle of wight whilst you retain what had previously been their tenancy.

well its tricky..it may be that you can make a good case for looking into a bigger place from the housing authority in your own right...
look into whether there are any 'house swap schemes ' in your council...make it clear why you need the space and the problems with the house you are in now....
there seems a logic in what you are suggesting with your brother and a natural justice but that doesn't necesserally hold water when it comes to housing policy....technically they would be sub-letting their flat to you so it could be a problem...its not necessarily an insurmountable one though....if you are living in a family members house while they are still there it may be possible to get your name on the rent book as an occupier...you and your husband would be named in order to calculate council tax...the pressumtion being that you would pay a contribution to the householder who is liable, then when they move on they might be able to transfer the tenancy to you...not only that if you are then made homeless because your brother moves then you are unitenionally homeless and must be rehoused (this is a risk i know as the rehousing might be not as good as you would hope but it must be appropriate and you can have reasonable objection)......now within different housing executives or councils or housing associations the criteria for tenancy negotiations may be different but it would be prudent of you to do this research from the point of view of being in the house already....i would keep paying money to compensate your brother for keeping the tenancy of the house open until such time as you are officially told otherwise.....at which point get citizens advise on your rights... do not take this or any other advise you get from here as gospel...you need to go very carefully here as being homeless is no joke
