I own a vehicle that has everything in my name only. This ex of mine has it and has not paid on it. He is running from child support and god know what else. I carry full coverage insurance on it also. I am not for sure were he is at this time. Last i knew he was in Green river Wy. I have to make the payment and keep the insurance up just to keep my credit. The law here in Kansas says that i have to get a lawyer and that before anything can be done i will have to know where he is. They cant even turn it in as stolen. I do not have the money for a lawyer and to me this just isnt right. Does anyone have advise for me. Please

My ex is just a ex boyfriend. Also we had a verbal agreement that it would be paid in 2 months. The law here says that since we made that agreement that they cannot do anything. Even though he renigged on it.

I don't understand why the police won't accept your report that it is stolen, if someone has it without your permission and won't return it. But if the local police won't accept the stolen vehicle report, try the state police.

You can also sue in small claims court, which may be enough to get a court judgment on the unauthorized use. Most states allow you to sue for the value that the other person has gained under the tort theory of "trespass to chattel" or "conversion", and they would generally be liable for the rental value of the vehicle during their time they used it. The small claims court can give you more details.

That court judgment would be a start. Also, many attorneys will take referrals and give you a half-hour or an hour free. Try that option, by contacting your local state/county bar association.

You can't report it as stolen because you gave your ex permission to use it. However, as the car is titled in your name, you can simply go get it if you know where it is & you have a key or you can get the cooperation of a locksmith or towing company. Be aware that many locksmisths & tow companies will not get involved without a court order.

Yikes! I'm so sorry. I would have said turn it in as stolen. Why can't you do that? It just doesn't make sense if it's your car. I don't know who told you that, but they are wrong. Call your local PD and tell them. Fill out a report and tell them where you think he is. They should be able to contact that PD and tell them. Also, go to your local DHS and tell them you have an absent parent and need help. They should be able to help you locate him as well. Good Luck hun!!!

check into women's groups in your area, even shelters, they can tell you what you need to do and where to go.
