Is it just me or does the following make sense to you?
A parent who has not paid a single penny in child support for a year asked the custodial parent if they (meaning the non-custodial parent) was to go before the judge and ask the judge to reduce the amount of child support and that way they would be able to pay thier chil support. Then if the judge reduces that amount of child support then that parent could send extra money so that the older of the two kids could get horse ridding lessons. Is this odd or and I over reacting?

The non-custodial parent is the mother and they are my step-children. She aloso wants the amount lowerd because she has court and probation fees. And refuses to change jobs or get a second job.

Hello! Basic needs are more important! Anyone can live without horse lessons but the needs like food, shelter, clothing and education should come first. Horse riding is a hobby and if you can't even pay for basic needs YOU have no right to spend on a hobby. That is only for those with disposable income.

The non custodial parent is shallow, stupid and psychotic! A pretentious social climber too!

This does not make sense. what is the difference between paying child support and getting the judge to lower child support so the non custodial parent can send extra money for the riding lessons, well let me tell you the non custodial parent will then only pay the lowered child support which benefits him and will probably have some excuse why he can't send extra money so the child loses out on everything. No judge in their right mind would lower child support for that reason anyway, child support is based on the non custodial parent's income. Do not fall for that!!!!!

Why would the non-custodial parent want to have the child support reduction and THEN give extra money to the custodial parent to pay for riding lessons?? I smell something fishy here. My guess is that with the reduction of child support the custodial parent would STILL not get any support, and the back owed child support that the custodial parent could collect (at some point, hopefully) would be reduced. The kids lose either way!

It sounds like a scam to help the non-custodial parent get out of paying their full child support due and once it is lowered it is gone. And I'm sure you know perfectly well that the "extra" money will never be seen. That parent is not only using this issue as a way to get out of paying full child support, but also as a way to cause a wedge between the custodial parent and the child.

If the child is old enough have them try to earn the money for lessons by working for other family members, neighbors, stables, etc. If not, tell them they have to wait until they are.

I'm wondering if it's your business because if your not in someone else's shoes--how can you judge? Maybe the parent can afford to pay for the horse riding lessons, which the child is entitled to, but cannot afford to pay what the judge says.
For the first part of your question, I would pick the basic necessities, but I wouldn't take something away from my child either.

It makes no sense to me. How can he justify asking for his child support payment to be reduced when he hasn't paid any for 1 year? Report him for non-payment and they will garnish his wages. As for the horse riding lessons, that's really not a necessity at this point in life. Clothing, food and shelter are of the utmost importance. Besides, how can he justify paying for lessons for one child and not the other?

It is odd, the non custodial parents need to go to court, get the child support INCREASED and have the custodial parents wages garnished or have them sit in jail.

Odd? Overreacting? Yeah, if you belive in elves, fairies, money will appear by magic, the checks in the mail, I won't come in your mouth, I'll pay you back honest, and all that sort of stuff. They ought to throw his sorry *** in the hoosegow, get him a huge set of pliers and squeeze till the money comes out through his pores.

Don't give up your legal judgment to a promise.Hes just trying to get it on paper that he doesn't have to pay his support.If he can afford the money for"extras" then he can afford to pay what he is already required by law to pay...sounds like hes trying to pull a fast one .don't go for it.Hes lying .get legal representation and go after the back child support ,if hes working you can get it.
good luck oh and tell him he can go to jail if he doesn't pay and you can get his income tax refund levied and you will get it not him,in some states they can lose their drivers license for not paying court ordered child support

you're absolutely right. i suggest you talk to the parent who has custody and ask if you can attend the hearing and testify against the non-custodial parent in his case to lower child support.
