How much time and what is the proceedure before I am forced to move out of my home. When the sherriff comes to evict us, will we have time to remove our belongings? This on a land/mobile home purchase in Mississippi with a past due of $1,476.96 with a DEMAND FOR PAYMENT ON 8/28/06.

The foreclosure process is not officially started yet. All you got was a demand letter. They haven't filed anything.

If the eviction order has already been granted by the court, you usually have a maximum of roughly 5-7 days to comply with the order and vacate the premises. But this depends on the period stated on the order and also by state....but usually no more than 1 week. You will be required to go back to court for the 2nd cause i.e. the money judgement, whcih you still must satisfy.

Before you consider the moving issue I recommend that you speak with the lender and see if you can strike a deal of a deed in lieu of foreclosure with some time to sell the property. This will avoid you taking a hit on your credit. Depending on the type of instrument that you have with the lender it can range from 30 days to months and even years. You most likely have 30 days to answer your notice before proceedings are instituted against you.

Typically, you have about three months from the time the notice of default is filed, thats not always the case, but a good rule of thumb.

State procedures differ. You will probably receive one or more notices informing you of the procedures to follow. You may have considerable time.
