If he is not on the birth certificate than he is not recognized as the childs father and therefore has no rights. He gave up all rights when he left you. As the child gets older and wants a relationship with his bilogical father than that is his decision- but for now I would confuse your child.

Why isn't the biological father's name on the birth certificate? What type of rights? Do you mean visitation rights? Well, this type of situation is hard. Is your child aware of whom his/her biological father is? I say never stop a biological father from being in the child's life. You as the mother would never want to be the reason for a child not having a relationship with their father. Also, it doesn't matter how bad the father is, never talk bad about the father around the child. Where has he been for the past 8 years? In an effort to protect the child's feelings from any further hurt, if he says he is coming to see him/her, don't tell the child. This way if he doesn't show the child won't be hurt. Maybe he's ready to be a father now and will be able to impart what this child needs. Ideally he should have been ready from the start but give it a chance. A father plays a very important role in a child's life. Fathers are very much needed. I think the two of you should talk and see exactly what he is trying to do. I hope this helps and that the decision is made with the child's best interest at heart.

Legally, yes. A very frustrating truth for the mother of said child. I feel for a mother and child(ren) in this situation. I hope the story ends in the best interest of the child.

I am fairly sure he does. You hear stories all the time that a birth father is trying to get custody of a child he fathered.

To get his rights, if your not giving him any, all he has to do is get a blood test. Yes, he has rights. But he will also owe child support. Maybe knowing this, he may not want to pursue this.
