My hubby got busted with drug abuse, paraphenilia, carrying a concealed weapon, and driving without a license. The judge said he will have a min of 21 months if found guilty(he plead not guilty). Tomorrow is his pre-trial. Will/Can he go to jail then, or will they wait until the actual trial? Also, what will they do tomorrow at the pre-trial?

Any info would help. Thanks!

Was it his first offense? If so, the DA may try to be lenient with him (that's the pre-trial). No, he will not go to jail from that, unless he does something like, oh, say, like argue alot in court (contempt).

My advice, seriously? If the DA offers a plea bargain for probation and drug therapy.....take it. Very small chance he'll win in a jury trial.

Pre-trial is where the Judge and lawyers get together to go over the details of the case, such as what motions have been filed and whether the judge approves them or not. Your husband may be offered a plea bargain. If the plea bargain includes some jail time, and it may not, he would probably not go to jail right away. If he doesnt take a plea bargain, they will set the trial date. I'm guessing he's out on bail at this time? That would still be in effect until the trial.

Well if he is guilty, tell him to cop a plea.. maybe they will just give him probation. However, his lawyer should be advising him on what to do/plead, etc.

It sounds like your hubby needs help. Would time in jail be bad if it got him off the drugs, driving with a license and not carrying a gun?

pre trial means they all get together on the case and argue some points before the actual trial no he will not be going anywhere tomorrow the weapons charge makes it very difficult to handle

It's a conference to see if this can be settled, or rather pled.. Do you have a lawyer yet? If not, get one pronto. Where jail is a possibility, spend as much as you possibly can. Quickly look into available local rehab or al anon programs if you are not familiar with them. He should be in one of these, and if he can show he's investigated the programs, this will be a plus.

as stated above the real problem is the drugs and weapons in same arrest, what type of drugs? how much drugs was on him? what state you are in north east harder on gun possession, did he have permission to have the gun within the state you live in?

so as some one stated above if the DA is willing to make a deal take it or it could be a long time before you see your husband again
