Protect yourself but I understand your hesitation. I would feel the same. We have become such a law-suit society. If it's for your own protection and insurance companies are envolved, you definitely need to protect yourself and your son.

Your first course of action is to go through your insurance company and let them coordinate with the insurance company of the guilty party, the truck at the beginning of the chain reaction, to resolve all legal claims for damages and injuries. If the insurance companies do not come up with reasonable compensation for your damages and injuries, then you would go to an attorney for additional claims. Personal injury attorneys will likely not charge you until the claim is resolved and then take a percentage of the damage award for their fees. My guess is that the truckers insurance should make a reasonable payment on the various claims. Your insurance should cover anything the truckers insurance does not cover. Between the two companies, you shouldn't have much left to worry about.
Good luck.

Yes, ma'am - you did the right thing. That's why we have insurance and a judicial system, so people can use it to correct wrongs comitted against them as well as possible. Good for you! I hope you are better now.

Yes, because if either of you develope problems because of the accident but didn't do anything right away it might be too late. You are just protecting yourself.

Yes. As long as you don't try to milk the system, what you did was fine.
