i just got a frantic call from a friend who was in a semi-bad taxi accident last month and ordered byher doctor not to return to work (waitress) for 45 days, she said she was served with a five day notice after she got home from the hospital and since she won't be going back to work and waiting on insuarance yadda yadda she won't be able to make the payment in 5 days, can the fact that her doctor ordered her back not to work keep her from being evicted?

Your friends financial problems are not her landlords problem.

She should have talked to her landlord and explained the situation and worked something out. If she is a good tenant and is getting salary replacement checks from the insurance company, they probably would have agreed to wait.

Your friend should apply for some charity right now so she doesn't get evicted.

Will her boss hold her job for her for 45 days?

Has she talked with the landlord and told them what is happening? If she knew from the beginning that this was going to be a problem she should have called them and told them and asked them for their assistance. They would have been more likely to work with her prior to this.
Does she have a lease? What does the lease say about non payment of rent? If she signed the lease that is the legal document. I don't think there is anything she can do.
Most lawyers will answer this over the phone and if they feel it is worth taking on they will.
I'm sorry she is having this horrible time, I hope she gets better and I also hope that instead of ignoring or not wanting to discuss bad issues with creditors that she learned to talk with them prior to this extreme.

This is the moment when being a good tenant reaps rewards. It also helps to keep a savings account with a miminum month's salary.

She definitely needs to talk with the landlord. But if she's been late before and no specific income coming in right now, she shouldn't expect too much.

This depends on what country she lives in. If it is the US the answer is NO, she is out! If she is from a country where there is a more liberal or socialist system, most likely. In the US, the capitalist system says if you are unable to produce or adequately produce, then you are little more than rubbish to be disposed of. All governments are not like this.

I would tell her to get an attorney and have them fight the legal battle for her. There are lawyers who will do it on a contingency basis.
