If person A has a BAC of .08 or higher and is sitting at a red light and person B comes charging from around the corner and smashes into person A, who is at fault? A link would be great.

Person B is at fault, Person A will probably get a DUI, I would bet that person A would try to leave even if it was thier fault.

There are some real bad drivers out there, I rather be on the road with someone with a BAC of .08-.15 than some idiots on thier cell phones.

Person A is at fault for the accident. However person B is probably getting cited (or arrested) for DUI. Person A's mistake doesn't nullify person B's breaking of law's. Also, most accidents are ticketed at the discretion of the officer. So if the officer deems person A's mistake was just that and not negligence then they wouldn't get cited. Person B still would though.

person B might be at fault but person A is still going to be cited just as you would be if you were sitting there in a stolen car.

actually, it is person B's fault for rear ending person A--blood alchol content has no factor in this. You can check this out with the local law library (usually near your local courthouse or county seat)

Person "B" would be cited for unsafe movement, left of center and reckless driving. Driver "A" would still be charged with driving while impaired.

in oregon the person who is drunk will be cited because you should not be there in the first place. you don't drink and drive.
