Any suggestions on where to look other than talking to an attorney - I was just wondering if anyone had been throught this before. Thanks

I think so. But it is not always wise, depending on the situation. If the other parent is a drug addict, drunk or has an unhealthy lifestyle the custodial parent should have a say so. A 13 year old will always go to the parent that has less rules, chores, etc. I think the judge should decide if its in the child's best interest.

They have the right to speak in court about custody and thier opinion of visitation, They are a minor and at that age the law is on the parent to provide the child for specific visitation.

The parent can be held in contempt of court if the child does not do the required visitation.

Now if they don't want to go there is a problem and that needs to be addressed as to why

Is it noncustodial in Texas or another state ?
You can call Legal Aid and ask the question for free or look it up in your Library in state Domestic law books they should have in the Reference section.
A 13 year old should be old enough. In most states they are.

You would need to talk to an attorney, they would need to make a case that the child has capacity to make such a decision. That would require the expertise of a lawyer.

a 13 year old can't cross the border without a legal guardian.
