You ask a great question, but the answer is simple. An independent or 3rd party will not be elected for president for some time and by the time it happens, there will be just as many independents in congress as the two parties have. And also, not all Dems and Reps necessarily follow the parties views to the letter.

I'd trust a Libertarian before a Green Party member.
Libertarian believes in securing freedom for all.
Whereas a Green is like a watermelon.....Green on the outside but red all the way through. Greens are liberals who will limit freedom in the name of freedom.

The 3rd party is only good as a tool on years that only has weak candidates. It breaks the majority and allows the other party to win

The president doesn't make the legilation - he/she just decides what bills to pass so it's likely that bills will probably still get passed and the President would still sign them. If the President wanted to influence legislation, however, then they would have to figure out how to work with the parties to get their stuff through.
The founding fathers had this figured out...
