take it back...under warranty and make sure you have the extended warranty...ours lasted 9 months until first warranty work then 3 more times in the next 4 months so Apple lemoned it and we got a new one BUT only because we had the extended warranty past the 12 months Apple warranty

hold menu for 8-10 sec it should be fine i heard this on the screen savers on ttv it happens too all the ipods its a flaw in the design theres no problem with yours it does it on mine too

That happens to mine all the time, the only thing I do is let the battery run out...but I'd try the other suggestions, might work!

reset it by holding play and the middle button at the smae time and hold for 5 secs

press down the menu and select buttons simultaneously.
it may take a few attempts, but it should work eventually.
if not, you [may] have to send it back for repairs.
