NO! You will not gain any ground on this, in fact the courts will favor the mother in a child custody case brought up by the father. What you want is an adjustment of child care. You would be suprised how many dads are over paying child support. HOWEVER!, If she is a dead beat mom and has NO job or income prepared to get waxed!

Unless you can prove shes been or pending charges of child or drug abuse, the courts will award resident parent custody to the mother, no matter what the husband wants. Along with this comes child support, the house, and possible spousal support, and youll probably end with state mandated visitation rights. The state child support collection dept will garnish the support out of your paycheck before you see it. The courts also dont tell the mother what to do with your support which I feel is wrong because some kids dont get things they need but this is the law. Sorry and good luck

I wouldn't think twice. heck ya! If you know you could raise the child better than she could. Obviously she doesn't have money so the courts would look at that, but I sure hope the only reason for filing or custody is because you care about your child and not because you don't want to pay child support.

Is she an unfit mother and do you think that the child will be better off with you? Think about what is best for the child. That should be the only worry do you already do things for the child?
