if a woman doesn't want a child, and somehow the child makes it out alive or something, can she sue? have there been any situations like this?
i mean, i know there is wrongful death sues and wrongful life, i just don't know any examples of wrongful lives. thanks

Very thought provoking question Corrinna! I'll bet that makes it to the top of the next things to sue over after this! I would hope that if that lady didn't want the child and went to the trouble of trying to rid herself of it and it came out living anyway, that she would with no hesitation contact Family Services and get information on how to adopt the baby out immediately. That is a baby that wants to live! She needs to get it to a family that really wants a child and then get herself fixed permanently. Good question. Good luck. Nana

I'm guessing you're referring to abortion. If a woman doesn't want a child for whatever reason (unplanned pregancy for example) there're other options better than abortion. If the child is a newborn then she could consider leaving it at a fire-station (I don't know if all states do that). Putting up a child for adoption is a better option than abortion. Rgardless of how many months a woman is pregnant...that's a life she's carrying inside of her, and having an abortion would be the equivalent of a murder. If a woman doesn't wish to get pregnant there're many different methods to prevent that.

I've heard cases of abortions not working and the baby being born. But its rare as the mother would surely have pregnancy symptoms after the abortion, and figure out that the termination didnt work! I would have thought that in this day and age of suing anyone for anything that it is possible.

for whatever reason she couldn't get an abortion and she doesn't want the child...then she should give it up for adoption. it takes 2 to tango...so who she gonna sue? the baby? can't sue the father unless if she was raped and i think that would be the only case.

I think if your talking about a termination that somehow hasn't worked (never heard of it but I suppose it could be possible) then you may have a case. The only one who could really answer this is a solicitor/lawyer. Has this happened to you or someone you know? You've got me very interested!!

To sue because an abortion went wrong is stupid. If she really doesn't want the baby then use adoption.

In the USA where ignornace and stupidity rein supreme youcan sue any one for anything.. but if your suing your ex for "wrongful life" let me know who it comes out.. I should sue my ex for 14 wasted years

Let me ask you this HOW does a woman spred her legs with some one she is involved with willingly and sue them for doing "IT"...lol

so u mean your abortion went wrong well when you go for an abortion and they have you sign something saying that if it fails it is not there responsibility so your stuck so get an adoption since you dont want the child...

you need to explain this a liitle more...are you talking about an abortion..and she had the baby anyways..because it didnt work? and they want to sue for wrongful life?

here's a few links I found abotu abortion survivors. I don't abotu any lawsuits but there are abortions that have gone "wrong". I use the term wrong loosely because a child that was born despite an abortion attempt cound never be considered wrong.
