In addition to the powers the Constitution gives the federal goverment, the states, under...................................., have powers of their own.

10th Amendment: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people."

The primary limitations on the states can be found in Article I Section 10, and Article IV, as well as the 14th Amendment.

Other than that, the states have plenary (broad, near unlimited) power, as long as they do not conflict with federal law or the Constitution itself.

In theory, the 10th Amendment grants all rights not expressly given to the Federal Gov't to the States.

In practice, the Federal Gov't has been crushing the rights of States since 1865.

we fought for states rights for 4 years. we lost, and were demonized by history. too late to try to enforce them now
