Say that you make something from someone elses pattern and sell it on eBay...that is bad. Say that you make it, wear it for a few times, and then sell it...that is not bad. What is the rules regarding that? If you make some changes to someone elses pattern and remake it as your own, you can get away with it. Does anyone know the rules about that?

Specifically I am interested in making clothing for reenactments. I want to make the garments historically accurate. The existing patterns are excellent, but I don't want to rip any one off.

The way patterns are sold, you have the right to use that pattern to create the item and then sell the results. My wife does it all the time (not on e-bay). She is a seamtress.

She could not, however, create a dress from the pattern and then attempt to copyright or trademark that dress as uniquely hers. She could take pieces from several paterns, put them together, and create a unique outfit that she could trademark. (Disigners do it all the time. There are only so may ways you can make a skirt.)

As far as wearing the item first: you can if you list the item already made and for sale. Advertise as like new.

My wife has several standards (Star Wars item are her best sellers). She list several items, then offers to custom sew in the buyers size. Get more money selling "custom" then selling premade.
