Yes, my husband used to manage nightclubs He says that they used to take expired ID's. He also says that he he would take ID's that he thought were fake. He would take the expired ones because people would give them to friends so they could get into the club. He would then send the ID to the RMV who revoke the persons license for 90-180 days.

Actually all are wrong. I own several restaurants and they are REQUIRED by law to confiscate expired and fake IDs.

I think they can if the use of this ID is considered a fraud.

Absolutely not .. .They have no authority to take a I.D. ... This is actually state property

depending on the state; if you are using it to purchase say alcohol..........yes they can. They are actually required to keep it and report it to the state.
