right of way is a legal term meaning exactly what it says .
have you actually mentioned it to him and he's refused to do something about it ?
if so i would suggest you write a letter to him explaining that if you are forced to take legal advice he will become liable for legal costs incurred , alternatively he can avoid any further action by clearing the land .

Seems to me that leaving it overgrown if you do not use it, does not mean that the right of way does not exist. Besides, in Scotland access rights have been changed by law anyway. So if the right of way was in Scotland, just leave it overgrown.

Speak to your local council if you feel you cant speak directly to the neighbours, they will send a letter asking them to see to the overgrowth. Simple.
