In December of 2004 I went to an ER menstrual bleeding that had lasted for 16 weeks. I did not have insurance, so they gave me a student doctor so that he could practice on me while the regular doctor watched. They decided that my problem must be PCOD and I was prescribed Progesterone. The doctor told me that I had to be sure that I wanted to take it, because it is a birth control, and if I ever want to have more children I shouldn't take it. He told me at least four times before I left that I had been given a birth control to stop the bleeding. I got a two month prescription from him and I took it exactly as prescribed. In January I got pregnant and I gave birth in October. I went to a different doctor this year, and she told me that what they gave me as actually a fertility treatment that they give to women with PCOD rather than a birth control, she could not believe how bad they screwed up. I just wanted to know if I had legal grounds to sue, and if I could win.

This happened at a Catholic hospital, and I had my tubes tied there also after I had my son. I ended up delivering without my regular doctor, and the doctor that delivered me was really hesitant and didn't want to tie my tubes. They stopped doing tubal ligations just two months after I had mine done.

By all means get a lawyer that is doing pro bono cases if you can't afford anyone and tell him/her everything. Just because you have no insurance doesn't mean you are a Guinea pig for anyone

As long as you can PROVE they said it was a birth control then yeah you can win. At least that would be my opinion, not a lawyer so can't give total assurance there. Now the hard part is if it is your word against theirs. What if they won't admit that is what they said in court? Do you have any further evidence if it is just he said/she said? If not you may have a hard case. Clearly if you can give evidence they said that or get them to admit it in court you can show they did commit malpractice. They assured you basically that you can't get pregnant or that it was very difficult, when in fact they were giving you a fertility treatment instead. I would also have that other doctor go with you, if you go to court, as a medical expert who will testify that it was just the opposite of what the first doctor said.

various med mal situations settle with confidentiality agreements. how are you going to discover those? You look "statistically challenged..." as in no longer understanding something approximately valid statistical comparisons. i'm particular there are various abortion-proper themes you could write approximately that don't contain statistical stupidity. suggestion: Write approximately "The annoying circumstances to find the advice required to construct a valid statistical assessment of scientific malpractice situations." I know abot these things. Only go to an attorney who specializes in medical malpractice. IN some states, not all, you may have dificultly collecting large damages. I hope your baby is healty and happy.....but some of these doctors are really messed,

To prove malpractise you have to show recklessness or gross negligence, not just an error in judgement. If the Doctor had a genuine belief in his treatment of you, then sorry you don't have a leg to stand on.
