Do I send them a Cease and Desist letter (does anybody have a template???, or what law I would state that they are violating?). And after that if they don't stop infringing my work, can you sue them?

If you've released your work under the Creative Commons license, then there's not many ways that someone could infringe it.

However, if the person has violated one of the few provisions in the license, then you can treat it as any other form of copyright violation, starting with a request to stop (Cease and Desist).

As far as your legal rights to sue, this is a question that must be answered by a licensed attorney, preferably one experienced in copyright and intellectual property matters.

According to what you're talking about. Do you have a patent on your work? If so, you have a case . if not, There's nothing you can do.
