How could someone expose me to their second hand smoke? If I didn't like it, I would simply move away from them. Who's ever there first should not have to move to accomodate the other person.

If that was illegal it would set a precedent for any other source of intoxicating fumes.
What about all the people that drive around in shitbox cars? Ever copped a lungful of the toxic smoke belching from the back of an unserviced car while you've been in traffic?

It depends on what the situation was , were they blatantly smoking towards you and being thoughtless. I think smokers should take a back seat to, non-smokers. If a smoker comes into a situation and smokes up the place he should be reprimanded or given a ticket, and fine or something. If you are a smoker, it doesn't make everyone else a smoker.

Think about what you just asked.....in theory, if you get a law like this passed, then it could potentially be illegal for someone to fart in your general direction (that methane gas isn't good to breathe in either), or if someone starts a car down the block and you smell their exhaust, then you could sue. How ridiculous!

Hmm im not sure, because maybe more than person is exposing you. It's also not their fault that they're addicted, their brain is making them smoke and coinsidently they're right in front of you.

Yes!!! All smokers should be shipped off to a smoke planet so they could all die of lung cancer in peace without having to hear us complain about it over and over again.
Or better yet, lets make it a law that everytime a smoker blows smoke you should be allowed to sit on their face and FART to your heart's delight. One fart in the face per puff of smoke!!! I think that's fair cuz we don't have the technology to ship all these smokers to another planet.

I think a smoker who violates your rights should fined.
Now how about my rights?
I have the right not to be subjected to all that RECREATIONAL use of autos and cycles, boats, etc..
The extra pollution is killing me.
I have emphesema, and the city and country kill me now.

IN MY STATE ,THEY ARE ALREADY WORKING ON IT . MOST PLACES YOU GO, YOU CAN NOT SMOKE.BUT WHO ARE THEY GOING TO CALL- IF YOU DO SMOKE- THE SMOKE POLICE. I DON'T THINK IT SHOULD BE ILLEGAL. AND IF IT WAS . LAW ENFORCEMENT COULDN'T HANDLE IT . YOU CANT PUT EVERY ONE IN JAIL. WE HAVE TO MANY LAWS NOW.
