I was having family problems and could not get time off. My fiancee had a drug addiction and had social services called on her while i was at work also she always lied to me. this created alot of stress on me so I started using drugs and alcohol more often to cope in my daily routines. I tryed to get time off but my boss refused to give it to me saying we were to busy,and if I could last till spring break (4 months) he would give me a leave of absence. I tried to make it through but the drug use became more and more as the lying continued and I was afraid I would lose my children.so I ended up leaving work, not quitting. I was told by my employer to go to a drug rehabilitation program. I tried to get in but was not able to because my employer would not cover it, and I could not afford it. Also I was looking after my chilren while my fiancee tried to get help3 months later I recieved a letter from work saying I had Quit Do you think I could get my job back? what should I do? any rights?

I am afraid you have to look for a new job. Also you will have to mend your drug habits - otherwise you will have the same problem, if not worse.

You "left work", didn't quit, and three months later your employer sent you a letter saying you had quit? And you really think they might just overlook it, and take you back? Well, if you were an outstanding employee until you got on drugs, they even might - but they don't have any obligation to, and you don't have any rights in the matter. Actually, even if you hadn't had the problems, you still don't have the right to stay employed.

Not showing up for work is, in essence, the same as quitting. Some places might let you get away with it for a day, but three months?

It sounds like you have a lot of problems you need to resolve. Good luck.

Most employers are "at will". They do not owe you the job. You need to find a way to get clean and sober and find a way to deal with stress so you do not find yourself in the same situation. Also, reevaluate your relationship with your fiance. Is this an example you want for your children? If she is the mother of your children, it will be tougher. It sounds like you are reaching out for help, so I think you are on the right track. There are so many ways to get help. Keep looking and don't let yourself be defeated. You might want to go to a local church and see if they have any programs. If not, try AA or NA. Admitting you have a problem is the first step. Then a sponsor can help keep you afloat. Please stop using drugs for yourself and your family.

They said you quit so they don't have to pay you unemployment. You may be able to get a legal aid lawer to protest that. If you get fired you can collect.
