Make sure you go to paypal and file a complaint and stop payment.
Also make sure you go to ebay and file a complaint against the user.

yes, you can file an item not received from eBay, the sooner you do it the better as you only have 30 days to file. You can file with PayPal first and they will lock any fees in his account. Remember you only have a few days so get with PayPal and file those claims.
If the seller does not have proof of delivery, you should win the claim but if there is no money in his PayPal account you may have a hard time getting the money back.

Ugh, I just had something silimar happen to me, it sucks that there are people out to SCAM you on eBay. Think of it this way, we can't trust anyone we buy from off the internet but we all take a risk anyway. Who knows what type of people are behind those computers screens. Fortunately, some are honest sellers with good intentions and some are out to steal your money. It's good that you paid with Paypal, now what you have to do is open a paypal claim in the resolution center in your paypal account. https://www.paypal.com/cgi-bin/webscr?cmd=_protections-buyer-outside
Paypal will take it from there and investigate, may ask the seller to provide them with a tracking #, evidence of some sort, if seller does not have it he/she may have to refund your money. I've been there, done that, and don't want to go back! Don't forget to leave that sucker a negative feedback warning others lol. The bad part of that is he/she may leave you a negative feedback too. It really is annoying. Sorry about that, good luck.

I had a similar problem one time. You need to do a dispute for item not recieved. I was given the money back from paypal. You can do it on paypal itself. I cant remember the link but it's there. You just put on there why you are disputing the payment and they will contact the seller. In my case the seller didn't respond back and I was payed back by paypal. hope this helps you in some way.

Never trust Ebay. Keep contacting the seller. Make sure you have your paypal confirmation # handy.U may also wanna check with paypal as well. Keep pushing them.These Ebay sellers are NEVER to be trusted.

Ditto, with the file of a complaint against the seller, both at Paypal, and at Ebay, and, if no satisfaction, I sure hope you used a genuine credit card so you can reverse charges (telephone and file THAT charge reversal today!).
If you used a bank debit card (a so called FAKE visa card) call the bank at the FIRST opportunity!

Back off the CAPS LOCK, buddy.
Just go to paypal and report the item as never received... then go to ebay and do the same thing.
No big deal.
Next time check the person's Feedback rating. If it isn't at least 95% or higher, don't buy from them.

Where was it being shipped from, If overseas then it explains the hold up, if from the states then I would be contacting the seller, did you check the sellers rating to see if they are trustworthy, I do not buy from anyone less than a 97% Rating, Good Luck

I would notify ebay and paypal both. I wrote to someone who did that to me and said if something is wrong to tell me before the day was out or I would report them to both. Withing 3 hours they responded and I got my item in a week. They apologized.
