You will need to petition the court for a modification of child custody hearing where he can tell that directly to the judge if thats what he truly wants. The judge will then award you custody of your son and remodify the child support and visitation rights, legally. Congrats on regaining your son and lots of luck

You can't go off of a verbal contract with custody. Ask him to kindly place it in writing and sign it....... then run like hell to your attorney and get everything filed so he can't go back on his words. Keep that contract close to your heart until your day in court. But you attorney should be able to get all the papers filed for the courts and you will be on your way. The best way is to have the contract written, ask him to meet with your attorney and you and go over the contents on the deal and then have him sign it with a notary standing over, so then it becomes a legal document and he can't say he didn't understand what he was signing.

See a lawyer about this. There is a difference between you having full custody of your son and your ex giving up his parental rights.

First get him to put it in writing and get it notorized. Go to the notary and have your ex sign the document. Take the document to your attorney and he will draw up an ammendment to your divorce decree. Contact your attorney now and let him know. child support amounts will need to be changed as well. just get it set up in family court in your state , get it in writting so there isnt any problems down the line
