For $300 and a trip to Home Depot, you could build a "chute" that would funnel the berries back into her yard. Make sure the apparatus is totally on your property. She might complain that you are putting refuse on her property but it wouldn't stick. Legally you would be in the clear because the origin of the berries were hers to begin with. You are just returning her "property". lol Killing her tree isn't a good idea legally or kharmically.

All you can do is try to talk to your neighbor and ask that they trim the tree so it doesn't grow over on your side. If the tree limbs grow out onto your side of the fence, I would think you have the right to cut them off up to the border of your property line. This won't prevent shade, but it may prevent the needles from falling onto your property. Secondly, the needles have an acidic pH and this may well be the reason why the grass will not grow. I would suggest you go to a farm store or to your local nursury or to a garden center and ask about "acid tolerant" grass seed. You may want to apply crushed lime on the affected area to raise the pH and modify it so that the grass seed you plant will better tolerate the soil pH conditions. You will probably want to apply crushed lime twice per year, in the early spring and in the middle of fall, to keep more needles and leekage from rain water onto your property from theirs changing the pH back again to acidic. You can buy a small hand-held pH meter at any garden store. Make sure you consult the box of seed which shoujld give you information on pH growing conditions.

A few pounds of ice cream salt is very effective, esp. spread out before or during a rain.
What about spraying the branches on your side of the yard w/ Round-Up? Round-Up kills the root by working through the leaves. And maybe if it didn't kill the whole tree, it would kill the protion that hangs over.

i know this is an ancient post but someone might need this info anyway lol... When she's not looking or not around, cut them to length but put a small dab of tar on the ends enough to cover the cut. The tar will stop them from growing outward

not legally, there are commercial agricultural herbicides that will do the trick.....however, illegally, the roots of the tree are in your property..the rule of thumb is the tree roots are as large as the tree line..therefore you have a trespassing problem.... check with the city park dept and county legal to determine your next move if you rent, file a complaint..spend your 300 bucks one of these ways

check your local zoning commission, if the tree is that close it may be in the easement and all it will take is a couple complaints ant the city will issue the neighbor a citation to remove the tree from the easement... wait do you live next door to me? you rat!

one night sneak out and put pop and sticky stuff all over it and all sorts of bugs will come and just keep doing it till the neighbor thinks something is rong and has it dug up and bys a new seller tree and sabotage that one too

Have you considered talking to your neighbor politely & let her know your concerns?
Why do anything secretly? She may want the tree gone also if the berry problem is really that bad (which I doubt).
