The pitch did not hit him . . . it just went behind him. Way behind him. It was probably just Bruney (I think that he was the Yankees pitcher who threw that ball) wanted to get even because E. Santana hit Jeter. Actually, I think later on in the game, Adam Kennedy got HBP from Bruney.

I am not familiar with the Juan Rivera situation, but there is a situation when a batter can be hit and not be awarded first base. If the pitch is in the strike zone, the batter will not be given first base. It is true that a batter will not be awarded first base if he leans into the pitch. He will be given first base if the ball is coming at him and he makes no attempt to get out of the way. This is only true of the ball is outside of the strike zone. If the batter has part of his body/uniform within the strike zone, and it is hit, he is not awarded first base.
You may ask how a batter can actually have a part of themself in the strike zone??? The most common thing on a batter (depending on their stance) that is in the strike zone is their front elbow...especially with huge protective gear that some batters wear on this forward elbow (think Barry Bonds).

Maybe he leaned into the pitch that is not a free base. The only time that you get a free base is if the umpires sees that you didn't lean into it and you got hit.
