I was never written up for the wholee 11 years I was there, and this happened as a result of me telling my employer this info. . Two months later on X-MAS EVE he told me I was no longer needed and that if I somwday choose to change my :"lifestyle" then I could possibly come back! I was amazed....Is this really o.k? And /or Legal?

Well it is not legal persay, but you don't have 100% truth that was the reason you were fired. If you find more proof, then you may want to address somebody!

You should hire a lawyer immediately. You cannot be legally fired because of your personal sexual preferences. That is crap. Do you have any written evidence of your employment there, you are entitled to your employee file and should have copies of all letters of commendation, good customer compliments and things like that! Your former boss and the company need to be facing a lawsuit for this. Your former boss is an idiot and so is Garry, they both need to grow up and live in todays world of acceptance of all people. Unfortunately, not all people are ever going to accept racial differences, religious differences and/or sexual preferences different from their own. Best of luck to you, get to a lawyer or legal aid as soon as possible, and kick these ignorant idiots to the curb. You will end up finding an even better job when this is all over. Well, it shouldn't be legal. You could call the American Civil Liberties Union, the unemployment office or better yet an organization like GLAD. I'm not sure whether the state or the country protects your job, but most likely one of them does.

If it is illegal, you might want to let your company know about it and see if they can place you in a better position. Perhaps the damages could be huge for this kind of discrimination which would give you leverage to get an even better job. Going to court can be difficult especially since your boss might be encouraged to lie in order to keep his job.

You should definitely talk to an attorney regarding this matter. I'm so sorry that you were fired (especially for something stupid like this).
I would think that its unconstitutional to fire you because of your sexuality; that would be discriminatory. Whether you are likely to prevail depends on the laws of your state, etc., which an attorney would have to advice you on.
Just keep in mind that getting involved in a lawsuit costs a lot of money and takes up a great deal of time.
I hope that you prevail if you do file suit - best of luck!

"map" is generally correct about the lack of any law which addresses "sexual orientation," but there is still some possibility that if you sued, you might be able to win a case against your employer anyway. That is why the case law in Arkansas is a good place to research. And a lawyer is best qualified to be able to do that research for you.

Unfortunately being gay is not in a protected group the way women, minorities, disabled, etc are. There is no federal law that protects a gay person from being fired simply because they are gay, the EEOC regulations don't cover it. There might be protection in state law but honestly I tend to doubt it in Arkansas. You should check though.

Only way it would be legal is if you misrepresented your s/p and if you were being employed as a counselor/expert giving advice relating to straight lifestyle (based on experiences that were non-existent). The guy should be sued big-time.

No its not legal and in violation of ACLU and the civil rights. The problem I see is that you told him in a private conversation. You need to have proof that he fired you because you are gay. Its not nice but you need to get him on tape or produce a memo or something in writing to support your case.Your rights are protected under the FLSA. http://www.dol.gov/esa/whd/flsa/

no,that's not legal at all.that's like firing somebody for race or religion as well sue the heck out of him.If this was me I would own that company by the time I was done with him.and his poor sorry azz would be working for me,then I would just up and fire him
