If you want to get married, why don't you apply for a fiancee Visa. It taked 3 to 6 months but they will give her the visa for sure and you will have 90 days to get married.
If she appy for a tourist visa and she is refused. It will be very hard to get a Fiancee Visa.

I have no idea. You don't say where 'here' is, and it is something that government will have 100% of control over. So it doesn't make much difference what anybody on Yahoo thinks about the situation.
Best idea is for you to begin the license process and the projected immigration process and find out exactly what her status is. If it doesn't work out, you might find it easier to go to Poland and marry her there, then apply to have her join you wherever you live, after you have been married.
Good luck to you both.

If he's right here interior the U. S., why does he might desire to flow back to Chile? He might desire to be waiting to end the finished technique right here till he entered illegally or with a visa that does no longer enable him to alter his status. The overstay won't set off a ban because of the fact it truly is under a hundred and eighty days.

Most likely she will not be able to come back to the states (if by 'here' you meant USA). If you want to get married, you can either do that in Poland and then she'll be able to come back with you or she can try to get a visa based on that information. There's always a way, she can call American Ambassy (which is located in Warsaw) and ask what are her options. Either way, it's duable. Good luck!
