My husband and I live in the house he and his deceased wife bought. In her will, she left everything to him. However, the will on the house is still in his and her name. What is the simplest way to get her name off? (and my name on?) We live in Texas.

It is my understanding that a new deed will have to be filed at the county courthouse. You may find additional information at the link below.

First it is necessary to determine if any type of legal proceeding beyond recording a copy of her death certificate in the public records is necessary. That depends on how title was held. Assuming not, he can record a deed to the both of you as husband & wife. You should consult an attorney to avoid the complications that often result from do-it yourself legal work.

Probate the will and then take that will to the office of deeds and property records. They will adjust the deed for you. As for you they can add you as well under community property.

I had to ask this question recently of the tax people in Texas.
