It depends on the software.
Most commercial software is a licensing agreement, and is non-transferable. Some other software (especially older software) this isn't the case.
However, if you never registered the software, then there is no way to determine if you were the original licensee.
I don't believe you can sell used PC games on eBay, but the chances of your being prosecuted for selling them for $5 at a garage sale are almost as remote as your being struck by lightning.

Yes, it is completely legal as long as you do not retain the software, registration codes or serial numbers.
When you sell it you must sell it with the original copy and all licenses and serial numbers.

it's only illegal if you're making a physical or electronic copy of the game and selling that. it's no different than selling a nintendo game cartridge.
