I have a large walnut tree near the fence, which devide my property and next door's.The roots of the tree invade next door's driveway and cruck her black top pavement. Must I repair her pavement? I live in New Jersey. I need answer from lawyer,please. Thank you.

No, not necessarily, I work for the City and the best thing for you to do is to call your Village Hall or City Hall office. Ask them if there is some type of ordinance that states that you have to replace the driveway and black top. Most of the time it will not be your responsibility because of nature taking its course and you can't help that. However if you have the money and you want to be a nice neighbor, then go for it! But if you are like the average person that has to save to do a repair like this, then look for the Ordinance (law) that states that you are the responsible party. Each town or city is different and have their own ordinance to follow, call and ask and go from there. Best of luck!!

Go to your court house and ask to see the land lay out to determine who's tree that property is actually on. If it's truly on YOUR property, then you are responsible for the repairs of the neighbor's driveway. If it's their tree and their property, it's their responsibility.
You might have to look in the phone book for people who specializes in trees to get the roots trimmed back. If it's a fairly large tree, you might have to have it cut down. I'd hate to see anyone cut a walnut tree down since they're so pretty. (that is if it's your tree and property).
