Saurman or whoever he was took it. How did he get his staff back? He was resued by the bird and the bird didn't have it. Later on in the movie he had it back. Also in some scenes there is a stone in it, but not in others.

He had his staff back when the "Fellowship" started their trip, before he fought the dragon.

If you pay close attention in the movie, his second staff is slightly different from the first. I believe Gandalf made his second staff in Rivendell, which is where the eagle took him, out of wood from the forest. And a wizards staff is not the source of their power but a way to channel it. Also the crystal in the staff was put there by Gandalf, again if you pay attention, and the crystal was just used for light, so he took it out during battle.
So there is no discontinuity in the movies according to the staff, Peter Jackson was very thorough in his detail for the movie.

that is because when gandalf fought with the dragon in the mines he then transform in gandalf the white and before that he was gandalf the Grey and if you want you can see the second movie because there is the explanation

Good question, huh?! That is lack of continuity and it happens in many movies. Also, it happens because a part is cut that would explain it.
