I have been on W/C now for 3 1/2 years. . I was seen by the company doctor which is who performed my 1st surgery. This doctor removed a bone from my thumb then stitched me up.While recovering I noticed that my thumb didn't look right. Come to find out through a new doctor, the 1st doctor didn't attach my thumb back to my hand. This required a 2nd surgery which was a over a year from the first surgery. By then carpal tunnel was present in my right hand. Surgery was required about 1 year after my 2nd surg. I just found out that my employeer was sold in Jan 2006. My attorney requested that I send a letter and asked that someone reply within 5 working day of my request. I received a call from the CEO. She informed me of the take over and said that the new owners terminated all the employees and then rehired back the ones they wanted, and notifed the ones they did not want to rehire. No one ever contacted me can they terminate you without notice?

I used to work in risk management, and I know that if you have a claim out, that they must pay it. PERIOD. They are still responsible.

You can suggest a settlement that you think will cover and future surgery and pain and suffering and loss of wages.

Your lawyer will better advise you, but no need to worry. You may have been terminated without notice, but they have every right to sell the company. No one would in their right mind would hire you from the new company because now you are a risk for them to lose money. (they will not tell you this however)

Is your health insurance through this company? If so, and you have not seen your service interrupted, it's likely the new company purchased the obligation to you.
You went through the state's worker's compensation program - that's a nice paper trail for you. Follow up with them and see what, if any, changes have been made.
Definitely take care of this now. And don't expect too much. 3 1/2 yrs is a long time to expect a company to keep you on as an employee. It's possible a $$ settlement would be to your advantage. (Just make sure your lawyer's fees aren't too high)

I think it's time for you to hire a lawyer. It definatly wouldn't hurt (no pun intended) to get a free consiltation. To me it sounds like there could be a huge settlement. Ecspecially if you have over 12% (differs from state to state) incapacitation in your hand due to your injury. But, to answer your question, I believe they do have the right to terminate you.

no one can terminate with out notice, and if they do they should pay total dues for termination and settle all disputes, hire a good lawyer and get justice.

I believe it is illegal to terminate you without notice. Call your lawyer immediately...they should be taking care of this for you. Good luck!
