Should the Border Patrol agents convicted of shooting a drug smuggler in Texas be given a new trial?

No!!!! A pardon and a medal would be better than a trial. Why does a drug smuggler have any rights?

Samsa- The belief that every human has rights no matter what their actions is the very reason that Pedophiles, Serial Killers, Rapists, have become so prominent. Humans in my opinion can easily forfeit those rights, including the right to life. Slime balls bringing drugs across the border, running from the police at high speeds endanger everyone else. I vote for the chunk of lead everytime

It's called an appeal. That's the way the legal system works.

We can't start making exceptions to the system because someone wears a uniform, or is an elected official, or because the victim is a criminal, or because the defendant is popular in the media.

Either the legal system works and applies to everyone, or it does not. I'll bet that none of the people on this board were there. They didn't sit on the jury. They don't know the facts.

The jury made its decision. That's the way the legal system works.

Actually, every human being has rights, regardless of their chosen profession or circumstantial disposition. Just because someone is from another country doesn't give any old hick the right to lob a bit of metal through their body.

Should that hick be given a new trial? Only if there was a fundamental flaw in his original trial which violated his constitutional right to a fair trial, such as a biased judge, ineffective assistance of counsel, denial of right to a jury, etc.
